Thank you for visiting the Farm FireSmart website (the "Site"). Farm FireSmart is an educational initiative owned and operated by Lac Ste. Anne County Fire Services.

These Terms and Conditions govern your access to and use of this Site. By accessing this Site, you agree to abide by these Terms and Conditions and all applicable laws.

Legal Entity and Scope

  • Legal Authority: For the purposes of these Terms, all rights, responsibilities, and liabilities rest with Lac Ste. Anne County, which controls, operates, and administers this Site from its offices in Alberta, Canada.

  • Permitted Use: The sole purpose of this Site is to provide you with information and resources related to the Farm FireSmart initiative. No other use is permitted.

  • Jurisdiction: Access to the Site is governed by the laws of Alberta, Canada. While we make no representation that the Site is appropriate for use outside of Canada, if you access the Site from outside Canada, you are responsible for compliance with all local laws.

Disclaimers and Assumption of Risk

Your use and browsing of the Site is entirely at your own risk.

  • Accuracy: While the County uses reasonable efforts to include accurate and up-to-date information, we provide no warranties or representations as to its accuracy or completeness. The County assumes no liability for any errors or omissions in the Site's content.

  • Technical Risk: The County assumes no responsibility and shall not be liable for any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, or files.

Limitation of Liability

To the maximum extent permitted by law, neither Lac Ste. Anne County nor any other party involved in creating, producing, or delivering the site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the Site.

Intellectual Property Rights

Ownership

  • Copyright: You should assume that everything you see or read on the Site is copyrighted unless otherwise noted. Material may not be used without the written permission of Lac Ste. Anne County except as provided in these Terms.

  • Trademarks: The trademarks, logos, and service marks ("Trademarks") displayed on the Site are registered and unregistered trademarks of Lac Ste. Anne County or others.

  • Prohibition: Nothing on the Site should be construed as granting any license or right to use any Trademarks or images without the written permission of the County. Unauthorized use of any images, Trademarks, or other content is strictly prohibited and may result in the County aggressively enforcing its intellectual property rights, including seeking criminal prosecution.

Third-Party Rights

The County neither warrants nor represents that your use of materials displayed on the Site will not infringe the rights of third parties not owned by or affiliated with the County.

User Submissions and Conduct

User Content License

When you submit or post any content to the Site, you represent that you have a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, distribute, and publicly display that content worldwide, in whole or in part, for the full term of any intellectual property right that may exist in such content.

Prohibited Content

You are prohibited from posting or transmitting any unacceptable content, including, without limitation, material that is:

  • Unlawful, threatening, libellous, or defamatory.

  • Obscene, scandalous, inflammatory, pornographic, or profane.

  • Material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law.

The County reserves the right to remove any unacceptable content or links posted by you at any time. We will fully cooperate with law enforcement or court orders requesting the disclosure of the identity of anyone posting unacceptable content.

No Monitoring Obligation

Although the County may monitor or review postings, we are under no obligation to do so and assume no responsibility or liability arising from the content of any user submissions or for any error, defamation, or inaccuracy contained therein.

Indemnification

You agree to indemnify and hold harmless Lac Ste. Anne County, its affiliates, officers, directors, employees, successors, and assigns from any claim or demand, including reasonable attorneys' fees, due to or arising out of your:

  1. Misuse of the Site;

  2. Violation of these Terms and Conditions; or

  3. Infringement of any intellectual property or other right of any person or entity.

Changes to This Statement

Lac Ste. Anne County reserves the right to change these Terms and Conditions at any time.
